Surrogacy Laws in Ukraine

Unlike most countries in the world, which prohibit or restrict gestational surrogacy, surrogacy in Ukraine is properly regulated as follows:


✔ Family Code of Ukraine


✔Act 1154/5 by the Ministry of Justice of Ukraine as of November 22, 2007 on amendments to the Civil Code.


✔ Act 771 by the Ministry of Health as of December 23, 2008 on approval of reproduction technologies.


✔ Act 1154/5, Section 3, paragraph 10 by the Ministry of Justice of Ukraine as of November 22, 2007 on registration procedure for children born thanks to assisted reproduction techniques: " In the event a child was born from a woman who has been transferred an embryo previously conceived by a married couple, the registration of the child's birth certificate shall occur upon request by the married couple who consented to the embryo transfer before a notary public."


Intended parents are considered biological parents as from the time of conception.


Thanks to the legislation above, there is no record in Ukraine of a legal action by a gestational carrier requesting custody of a baby born thanks to surrogacy.
