Surrogacy Agreement

The contract entered into by families opting for surrogacy in Georgia and Ukraine is a mandate agreement: the intended parents are the principals, and the surrogacy center is the agent.

Watch the video to see the contract we signed with our surrogacy center; it features the same format and content as the ones currently being used in processes in Georgia.

It is drafted in two columns: the left side in the local language and the right side translated into the language of intended parents.

The surrogacy center we chose offers different contract options based on each family's needs: the most comprehensive one offers unlimited embryo transfer attempts until a successful birth, meaning a guaranteed program. There are other options, depending on whether the family already has cryopreserved genetic material or if they are opting for assisted fertilization with or without gamete donation. Some families may prefer to cover one embryo transfer at a time instead of opting for the unlimited program.

All contracts outline information of the intended parents and the surrogacy center, define the technical terminology to be used in the agreement, and establish the payment method for the process.

Next, rights and obligations of both parties are detailed, including the contract term and procedures for special situations. Guidelines on confidentiality and how the family should prepare for the program are established, along with a description of the stages until the birth.

The contract also addresses additional services included in the unlimited program and any expenses that may arise outside the contract.

Finally, the parties and the contract translator sign the document.
